By placing an order on www.daniellebalfoort.com, you are accepting to purchase a product on and subject to the following terms and conditions of Danielle Balfoort Embroidery Art.

The General Terms and Conditions always apply between you and Daniëlle Balfoort Embroidery Art when you use or place an order through the website www.daniellebalfoort.com. The General Terms and Conditions contain important information for you as a customer of Daniëlle Balfoort Embroidery Art. Please read them carefully. We also recommend you save or print the General Terms and Conditions, so you can consult them again later.

All Dutch law applies to all agreements concluded with Daniëlle Balfoort Embroidery Art.

Prices and information

All prices are displayed on the site in euro’s, including 21% VAT. Shipping costs are excluded.

1.1 All prices as displayed on the Site and on other materials originating from Daniëlle Balfoort Embroidery Art include taxes (21% VAT) and other levies imposed by the government unless stated otherwise on the Site.

1.2 If shipping costs are charged, these will be clearly stated on the Site before the Agreement is concluded. The shipping costs will be displayed separately in the ordering process.

1.3 The content of the Site is composed of the greatest care. Daniëlle Balfoort Embroidery Art can however not guarantee that all information on the Site is displayed correctly and/or is always complete. All prices and other information displayed on the Site and on other materials originating from Daniëlle Balfoort Embroidery Art could include typographical and/or programming errors. Daniëlle Balfoort Embroidery Art cannot be held responsible for such typographical and/or programming errors and always reserves the right to correct such errors.

1.4 Daniëlle Balfoort Embroidery Art cannot be held responsible for any deviations between the color of the Product and the color of the Product as displayed on the Site.

Conclusion of the Agreement

2.1 The Agreement will be deemed to be concluded at such moment that the Client accepts the offer of Daniëlle Balfoort Embroidery Art., which offer is subject to the General Terms and Conditions.

2.2 If the Client has accepted the offer by electronic means, Daniëlle Balfoort Embroidery Art will also confirm receipt of acceptance of the offer by electronic means.

2.3 If it is found that, in accepting or otherwise entering into the Agreement, the Client has provided incorrect data Daniëlle Balfoort Embroidery Art will have the right to suspend its obligations until the correct data has been received from the Client.

Execution of the Agreement

3.1 As soon as Daniëlle Balfoort Embroidery Art has received a Client’s order and has confirmed the acceptance thereof, it will hand over the Products to the shipping company as chosen by the Client in the ordering process. The shipping company will then send the Products to the Client.

3.2 Daniëlle Balfoort Embroidery Art is authorized to engage any third parties in the fulfillment of its obligations under the Agreement.

3.3 The Site includes information describing the manner of delivery of the Products and an estimation of the term in which the Products will be delivered to the Client.

3.4 If Daniëlle Balfoort Embroidery Art is unable to deliver the Products within thirty (30) days after the confirmation of acceptance of the order, it will notify the Client accordingly. In such event, the Client can decide to either agree to a new delivery date or to dissolve the Agreement without incurring any costs. Daniëlle Balfoort Embroidery Art cannot be held liable for any delay in the delivery process.

3.5 Daniëlle Balfoort Embroidery Art advises the Client to inspect the Products upon receipt and to report any defects within two (2) working days after delivery in writing or by email to info@daniellebalfoort.com

3.6 As soon as the Product has been delivered to the delivery address submitted by the Client, the risk of the Product fully transfers to the Client.

3.7 If the ordered Product can no longer be supplied, Daniëlle Balfoort Embroidery Art is entitled to deliver a Product which is comparable in nature and quality to the ordered Product. In that case, the Client will have the right to dissolve the Agreement without incurring any costs and to return the Product free of charge.

If unexpected items, for whatever reason, have a longer delivery time, you will be notified by e-mail. This also applies to items that are no longer available.

Payment

After ordering you will immediately receive a confirmation with an overview of the ordered items and the total amount, the payment must be made in advance.

The Client shall pay the amounts due to Daniëlle Balfoort Embroidery Art in accordance with the ordering process and through the payment method selected on the Site. Daniëlle Balfoort Embroidery Art is free to offer any payment method of its choice and may change these payment methods at any time.

Our articles will be sent through Post NL
Shipping costs within the Netherlands or Worldwide will be shown during the buying process on the site.

Warranties and Conformity

4.1 Daniëlle Balfoort Embroidery Art warrants that the Products are suitable for their intended use, as described on the Site.

4.2 If the delivered Product fails to satisfy the Agreement at delivery, Daniëlle Balfoort Embroidery Art must be notified thereof within a reasonable period, which is ultimately fourteen (14) days after delivery of the Product.

4.3 If a Product does not satisfy the Agreement and the Client has notified Daniëlle Balfoort Embroidery Art thereof within the period mentioned in article 8.2, the Product concerned will be repaired, replaced or (partially) refunded, such in consultation with the Client. Complaints after the period mentioned in article 8.2 will not be accepted by Daniëlle Balfoort Embroidery Art

Return Policy

If the order does not meet your requirements, you can return the item within 14 days of receipt. You must first register the item as a return via info@daniellebalfoort.com Daniëlle Balfoort Embroidery Art will confirm the return shipment, after which you can return the item. All return shipping costs are borne by the customer. The article to be returned must be in its original state, undamaged and unused. The amount paid by you, excluding shipping costs, will be reimbursed as soon as possible, but no later than within 30 days.

This does not apply to personalized products!

Delivery

Daniëlle Balfoort Embroidery Art is never liable for the loss or damage of shipped items. The ordered items are packed with the utmost care. However, shipping is in all cases at the risk of the buyer.

Cancellation

You have the option to cancel the order within 24 hours after placing an order, without extra costs. You can cancel via info@daniellebalfoort.com If you have already paid for the canceled order, you will receive the amount paid back.

Personal data

Your personal information is stored in the Daniëlle Balfoort Embroidery Art customer system to process the order. In addition, Daniëlle Balfoort Embroidery Art uses your data for internal marketing purposes, such as sending mailings. Daniëlle Balfoort Embroidery Art naturally applies the relevant legislation when using your personal data.

Liability

Daniëlle Balfoort Embroidery Art is not liable for (technical) advice provided by it, printing and typing errors on the website, technical data provided by suppliers or producers and unforeseeable and reasonably uncontrollable poor quality of the products. The liability of Daniëlle Balfoort Embroidery Art is limited to the amount of the invoice sent in this regard.

Disputes

Dutch law applies to these terms and conditions. Disputes are resolved as much as possible in mutual consultation. Although Daniëlle Balfoort Embroidery Art does its best to offer all information, services and products as good and error-free as possible, it cannot be held responsible for any errors, defect, lost income or other damaged consequences arising from the use of this website.
